Welcome to RoadScore. By downloading, installing, or using the RoadScore mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the App, you must create an account by providing a username and vehicle information. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

3. App Usage and Safety

Important: RoadScore is designed to record and analyze trips. You must always prioritize safe driving. Do not interact with the App while operating a vehicle. Start and stop trip recording only when your vehicle is stationary. RoadScore is not a navigation tool and should never be used as a substitute for attentive driving.

You agree not to use the App in any manner that could endanger yourself or others, violate any traffic laws, or promote reckless or dangerous driving behavior.

4. Subscriptions and Purchases

Subscription Plans: RoadScore offers auto-renewable subscription plans (Starter, Pro, Pro+) that provide access to premium features and monthly AI credit allocations. Subscription details and pricing are displayed within the App.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate.
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Credit Packs: RoadScore offers one-time credit pack purchases that provide AI generation credits for the ModCar feature. Credits are non-refundable and do not expire. Credit packs are consumable in-app purchases.

Refunds: All purchases are processed through the Apple App Store. Refund requests must be submitted to Apple in accordance with their refund policies.

5. ModCar AI Feature

The ModCar feature uses artificial intelligence to generate modified versions of vehicle images. By using this feature, you agree that:

• AI-generated images are for entertainment purposes only and do not represent real vehicle modifications.
• Each generation consumes one credit from your account balance.
• Generated images are saved to your ModCar Gallery and may be stored on our servers.
• You will not upload images that you do not have the right to use, that contain inappropriate content, or that depict illegal activities.
• We do not guarantee the quality, accuracy, or suitability of AI-generated content.

6. Leaderboard and Community Features

The App includes a global leaderboard that displays usernames and performance metrics. By participating, you agree that your username and driving statistics will be visible to other users. You agree to choose an appropriate username that does not contain offensive, misleading, or inappropriate content. We reserve the right to remove or modify usernames that violate this policy.

7. Location Data and GPS

The App requires access to your device's location services to provide trip tracking functionality. By granting location permission, you consent to the collection of GPS data during active trip recording as described in our Privacy Policy. You can revoke location access at any time through your device settings, though this will disable trip tracking features.

8. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by RoadScore and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App.

9. Prohibited Conduct

You agree not to:

• Use the App to violate any applicable laws or regulations.
• Manipulate GPS data, trip scores, or leaderboard rankings through artificial means.
• Attempt to gain unauthorized access to the App's systems or other users' accounts.
• Use the App in a way that could damage, disable, or impair its functionality.
• Upload malicious content, spam, or inappropriate material.
• Create multiple accounts to manipulate rankings or circumvent restrictions.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. GPS accuracy may vary based on device capabilities, environmental conditions, and other factors. Trip scores and statistics are approximations based on available GPS data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, RoadScore shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages related to driving incidents, data loss, or unauthorized account access.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination will remain in effect.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes through the App or other appropriate means. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
